I got my 2007 Chevy Cobalt on April 13th, 2008 and my loan was given to Drive Financial and then Satander Consumer. My payments are $468.71 a month. My car was worth 13K at the time I got it and I have not been able to make a single payment towards the principle balance because of misc fees that they refuse to explain. I am a responsible person and I try to keep my bills up to date but with my rent and other bills I have to pay for I simply cannot afford to pay them 468.71 a month which causes my acct to fall behind. They offered me a deferrance but only after the loan is 30 DAYS PAST DUE!!! Everyday I am late I recieve late fees and when I do make payments it goes towards the interest and nothing else. I am so far behind in trying to make payments that no one wants to refinance and when I ask Santander to refiance they say no and give no VALID reason. Even when I pay early it does not go towards the principle. I am very close to just giving the car back but if I do they will charge over 10 thousand dollars to my credit. Someone please help. Had payment arrangements with HSBC Auto Finance. Was behind 1 month and was told to pay an additional $50.00 per month until caught up with my $350.00 payment. Sent in a few consectutive payments, when I got a letter that Sandenter was taking over our account. Paid Oct-Nov 2009, was making my Dec 2009 payment and was harrassed -called-30 times by Sandenter and a rep told me that I was late and needed to send in payment, I explained to him I was going to immediately, same day. He proceeded to tell me my vehicle financed thru HSBC auto finance was now 'Charged Off' and I need to pay 10K plus fees just after I made my payment. I was furious and asked for an explanation of why my car was charged off? No explanation given. Sandenter said I had no options but to pay in full of 10K, last payment I made was Dec 2009 after they said my car was charged off. They have attempted repo but car is still in my possession. I am looking for assistance on lawsuit and possible pay off with settlement to HSBC-Sandenter.

I am the first to admit. I did not always pay EXACTLY on time. I did however, make each payment before the next was due. In April, I had saved enough to actually pay 3 weeks ahead of time (This would have been my May payment.) In June, I called in my payment as I have done for 5 years. In July they sent out a repo order, and my Jeep was taken from my worksite. At this time, I owed approx $1200. They stated I had not made a payment since APRIL! They called my work, my family, my friends to "share" my financial information DAILY. They "fined me $500 storage fee, even though I had paid Cash (with a receipt) to the actual storage yard. Their idea of penalties raised my loan to $4000. When I would speak to people in the corporation, they were rude and misleading. Often times lying to me and my family/friends about who they were. This is a completely asinine way to run a business and a crooks way to steal more from those who have the least to give!

Gloria said I was late on my payment I explained my situation about home, job difficulty but I promised to make payment on 08/20/2010 and I was told to call it in but was ask if I had $200 to secure the promise. I said no I am totally broke. Then she put me on hold a man by the name of Dionne Miller claiming to be the Account Manager for my account told me if I didn't call back in 2 hours with a payment of $200 he would put out a repossession order and then he ask me for the license plate number and the color of my vehicle. I automatically knew that the statement he made was bogus but the fact that he was rude, I couldn't get a word in, inch wise.

I financed a 2006 Ford Focus ZX5 through Santander in 2007 for well over 12,000 dollars. I have made well over 26 payments on the vehicle and they tell me I still owe well over 12,000 dollars for the car!! I have added up the 26 paymentsand it comes to over 10,500 dollars to which they have added to the interest!!!! Yes that's right the interest!! This means that all this time i was making payments, I didn't even put a dent in the principal!! How is this mathematically possible?? to add the finance manager that I originally worked with for this vehicle is no longer with the company in any way possible. I have called repeatedly over and over and over and over about having the principle refinanced only to be met with threats to repo the vehicle. How is it logical to pay over 10,500 dollars cash in just interest alone over 3 years and not make one dent in the principal AT ALL!!! I'm sorry to reapt myself , but this is just absolutely mind boggling to me!! I have now been given to the so-called "service" manager who has basically told me that if I don't make payments which break down to about 405.00 bi-weekly they will come and repo the car the car. This was given as the answer to them refinancing the principal of 12,500 to which I still owe after 3 years of making payments of 405.00 to which they can't even explain why they only have credited just 26 payments. Unbelievable. I need help beyond the worst way!!

My husband has the note in his name alone. They call him and his work at least 35 times a day. They got a hold of my number, now they call me about 10-15 times a day, all hours of the day. Constant! He pays what they tell him to pay to get caught up, then they send him an outrageous bill! They are cruel and are doing many things illegally. They lie, they just want your money and, when you give it to them, they want more! He paid the payments 4 days late every month (due on 16th, he doesn't get paid until the 20th) and they charged us over $100 every month for being 4 days late! They are insulting and should be shut down! He paid over $1,200 to them in March (he didn't even owe that much!) and they sent him a bill the next month for another $1,000! We're ready to fight!

Rep said the loan was written off and nothing they can do about it. They will not negotiate. Was told I would have to pay the full balance plus $400 in repo fees. 82 year old retiree trying to work with these people and they repossessed my vehicle instead of waiting one more day to get their money. Then then added a $400 recovery fee to my loan balance and I also had to travel 30 miles to retrieve my car from the inpound yard at that cost me of $50 as well.
Nasty, Nasty people to deal with over the telephone. Very deceitful people, never told me about the added fees although I repeatedly asked what the total dollar amount would be to get my vehicle back.
These unscrupulous people knew they were dealing with a senior citizen and stuck it to me as much as possible, whatever they could get away with. Nasty, unscrupulous and deceitful people.

I had no clue what was going on and the lady on the other end could barely speak english. She told me they bought my loan and that I had to make payments to them from now on. She said that there was a notice sent out the month before stating the change, but I never recieved anything. She was very rude and I told her I was not making a payment to them, because I did not know who they were. She said she would send me the paperwork, but I have yet to recieve it. I don't know what is going on but this is rediculous.

Now that it is time to pay off my car I am being charge a more than $250.00 in Misc. Fees, $166.77 of which I already paid apparently and cannot be credited since it was already applied? I never authorized any misc. fee to be paid. This is on top of a $10.95 fee for using the online system or over the phone. If I have a 4 year loan that is over $500 in the course of the loan... then add the interest rate. I feel as if I have been raped financially from this company. I want redemption.

It all started on 3-7-10 I recieved a letter from Santander that they reached an agreement with HSBC to serve as a third party servicer. On that letter it said " If you currently pay using automatic bank draft your regulary scheduled payment will continue uninterrupted" Well that was not the case I recieved a statement on 3-29-10 that said I was late I contacted them on 4-5-10 and asked why I am late and what had happened The operator Carmella said that I had stopped the payment, I asked her why I would do that first off then told her I had not done that and her company made a mistake, I asked to talk with her supervisor Marshall came into the conversation he told me the same thing I had stopped the payment well I went to my bank and they had no record of a bank draft nor a stop payment that I had made. After I told him I was not late and his company did this I asked him to defer the march payment to the end of my loan since this was a mistake and I had never been late in the 36 months on the loan. He said to me I cant do it because you are now 22 days late. I then asked him to speak to his supervisor and he told me "I am as far as it goes" and he would not be transferring me to noone else. I then went back to my bank and got a printed copy of all transactions and not one was from santander.I called on 4-15-10 to see if the autopay had started back it had not so I called and got in touch with Racheal another manager I told her what was going on and proceeded to pay for aprils payment I told her the march payment was not settled yet, she said she would make it for april I made the payment and she gave me a confirmation # for the regular months payment I asked her what that was she told me and I asked again what the amount was and confirmation# was she gave it to me. I then went back to the bank to make sure I was correct about the information before I filed a complaint then got disturbing word of they had sent in a payment plus late fees!! I had been lied to again by this company. I am now pissed beyond belief and will file complaints with everyone possible The federal trade commision the BBB and Office of consumer credit in texas I will also write the president and ceo Thomas Dundon every month just like a payment I suggest everyone do this fill his box up with our complaints.

We were behind in payments which we indured their harrassing phone calls, mean accusations, and rude comments about our lack of responsibility. My husband was deployed to Iraq, and I made up the payment due plus I added an extra $200 to what was owed. The amount owed was $1,055 and I paid $1,200. I paid during the day, during normal business working hours and I was told that everything was fine. We were caught up and no other actions were needed. That evening about 7:00 pm, the repo guy showed up and took our van. My 2 sons (ages 5 and 4) are stuck in the house, out in the country without any means of a taxi cab, public bus, or friends to take us into town for food, water (we just had a flood and the public water system hasn't been cleared for consumption) and no way of picking up the vehicle, which they took to a place out-of-state. I was told that I have to pay the impound fees and have to pick up the van myself. I don't have another vehicle that I can take to pick up the van without leaving my 5 and 4 year olds at home -- alone. I can't take them in a 2 seater vehicle without their car seats, which are in the repo'd van. Drive Financial admitted multiple times that it was their fault but "We can't do anything more for you" and "We can advise you but we can't help you". Most of the time they just hang up the phone on me in mid-sentence.
How can a company legally repo a vehicle when the payments are current?

I lost my job and before I got behind I contacted them to tell them about my situation. I asked to defer a payment and they told me I had to get behind before they could delay the payment. Once the payment was due I called again and they said I had to make a payment and be current and be current before they could defer a payment. At the time I had no money. Then the harrasing phone calls started 5 to 10 times a day even after speaking with them id get another call an hour later. Then they started calling my 86 year old mother 5 to 10 times a day. I would call them back and try to work something out and the rules would change everytime I spoke with them. I finally came up with the money to make a payment and did so. Then they again changed the rules on a deferment and would not work with me. I am sending them every dime I have each weak cause I need my car and I keep getting further behind and the calls dont stop even after telling them when I can pay. Someone has to do something about this company and the way they are treating people. It has to stop.

I originally financed my truck through Drive Financial. I losted my job and got behinded. I inquired about refi but i was told i had to qualify. Once i was told i had to be at the point of repossession, then i was told i had to less than 15 payments from the payoff. Last i was told they did allow refi. I really don't mind making my payments because i love my truck but when things such as job security are out of your control it seems like the complany could make a comprimise. Its not like im trying to stiff them for the money. I'm only asking for a more reasonable payment solution so that i can catch up my payments and stay current.

My payments were made to Sovereign Bank and cashed by said bank. I always paid more than what was owed on the car loan I was running a month ahead on the payments anyway. Apparently, the car loan was sold to Santander but instead of being told this they just presented themselves to me a collection agency working on the loan for and through Sovereign Bank. Due to the economy slowing my carpet business was suffering and I sent a letter to Sovereign asking them to be patient as the busy season for carpet installation was fast approaching. Meanwhile, I secured a job in an industry I had been in for ten years previously so I could get caught up. In addition, I had given up my rental home in lieu of becoming a room mate in order to further free up my finances. Finally, I lacked $250.00 to get it out of repossession, running two payments behind. I made arrangements with them to pay this amount on Friday May 14, 2010 with an additional payment shortly thereafter. On the wee hours of Thursday morning May 13th a repo man came and got my van and ironically this was the day I started a new job for a major grocery store chain. It was the grand opening and I had to go to work basically hitching a ride and in shock with all of my personal possessions and tools God knows where. I had many items from the move in there including taxes and personal papers and finances...
I would have voluntarily given the vehicle up had there not been any other options but for them to be dirty and make arrangements and then pick it up with no regard for someone who had paid on time for three years. When I could finally arrange for a day off so that I could go pick up my belongings as the recovery company told me I could only come between 8-11 am m-f, a whole new problem arrived on the scene. THE AUCTION COMPANY WAS THERE TO PICK IT UP AND AS THEY DROVE IT PAST ME I NOTICED IT HAD BEEN DAMAGED SEVERELY IN THE RECOVERY PROCESS. THIS VAN WAS IN PERFECT NEAR SHOWROOM CONDITION AND THE WHOLE BACK QUARTER PANEL INCLUDING RIPPING OFF THE RUNNING BOARDS I HAD PUT ON WERE GONE. The recovery company would not let me notate this on the paper I had to sign to get my things nor would they admit to anything. In fact, they had a incident report stating it was like that which is a complete and total lie. I had full coverage on this vehicle there is no way there would be any damage on it, it was my baby and my livelihood. Now where does this leave me? They want me to pay $2000.00 to get it back for a vehicle that was trashed after having made arrangements with me. How can a company operate this way?? In addition I had not officially moved in yet so they were trespassing on my room mate’s property. How can these people operate as OUTLAWS and get away with it??? Who holds them accountable? Please let me know as I do not want anyone else to have to suffer such losses and emotional and financial distresses. Class action lawsuit? I'm IN!!!!!!!!!!

Santander purchased my loan from HSBC. I was laid off last year took a lower paying job to get by had a few late payments. I got a new Job in December 09 have made a regular monthly payment on the due date each month. They keep saying I am a month behind. I have spoken with several reps at Santander they tell me to make a payment and once it post call back and change my due date. I start calling the day the money come out of my account and they tell me I dont qualify for a due date change. Then the process starts all over again. I have made seven payments on my due date but they keep reporting me to the credit bureau's for being over 30 days late. I try again each mont to no avail. They are killing my credit when I am trying to buy a home. No one will work with you and they wont transfer you to any one higher up the ladder. I only have enough money budgeted each month for my regular payment. Looks like I'm stuck a month behind because there is no resolution and no one is honest or willing to help.

I started to fall behind on payments. i was sent a letter by santander that they just took over my loan from hsbc. they want to modify my account make my payment less and pay a lower interest rate. i made the payment required by the letter and faxed a signed copy of the terms to them. 30 days later they still havent approved my modification. i am being told by service reps not to pay and the modification will be done in 3 or 4 days. this is a month later then i get hold of the modification team and they say re-fax the agreement and we will get it processed in 24 hours for you. they call me the next day and say that is was declined because the offer expired. i was steamed. so you mean to tell me that no one in this company could have told me that this was going to happen to me after everyone said that it will be settled within a few days. now i am 3 months late and i am sure they will be coming for my car. they are not only brain dead people but they are crooks and liers. worst company i have ever had to deal with in my life. i hope someone will burn them good and get back what they have been taking from us for years

I purchased my Gap insurance throught Drive Finanical back in Oct. of 2007. My car was resently stolen and claimed as a total loss in Dec. 2009 and so my car insurance paid their portion, then when my gap insurance was to kick it and pay the remaining they oly paid $1,900.00 of the $5,000.00 owed. It turned out that when Drive Finanical sold me the Gap contract there was an additional page with all kinds of terms that weren't listed on my addendum I was given. So the gap insurance didn't cover alot of the finanice charges left on my loan. I even have proof that I never recieved the second page. The offer to settle with half but I'm not satisfied. What rights do I have, how can I get them to take the whole balance off for selling me an incomplete contract.

I bought a car in 2002 which was originally through Drive Financial services which was taken over by Santander. My loan is suppose to be paid in full come come July 2010. I have made substantial payments and fees keep getting added to my loan. The last fee was for $202.00 for apparent late fees after being late one day on a payment and this has happened several times. I made a substantial payment to pay-off this car with my tax money which was an automatic withdrawal from my bank account which they only show $400.00 being paid on the account. I provided the accounting department at Santander a bank statement and they will not return my phone calls regarding this matter. Due to this my attempt to get a new car loan with a differnet company is being rescinded because they will not provide documentation needed to the new car loan company. I want this resolved and my loan paid in full which whould be less than $3,000.00 but because they keep putting additional fees on my account my balance is showing $3,810.00. My purchase price of the car was $12,000.00 and with all the fees they say I've incurred I have paid over $25,000.00 for a 2002 vehicle.This is reidiculous and I would like some assistance in this matter. I pay my SOVEREIGN BANk auto loan every month. Not 1 late payment. I use the new SANTANDER payment stub which has an "ADDITIONAL PAYMENT" area. I have been adding additonal funds on this line for almost a year to find out that NONE OF THE MONEY GOES TOWARD THE PRINCIPAL. Santander holds the extra money and puts it toward the next months payment. So, They are still billing 100% of the interest and I am simply paying off the next months payment instead of paying off the vehicle early or earning interest on the additional funds I send them.
To top it off, the customer service people are the rudest I have ever talked to. I was told to call a "customer payment specialist" to arrange to add funds to the principal.

My loan was a HSBC loan. It was bought by Santander Consumer USA. I received about 8 calls a day, from different area codes. I was 1 month late. I called customer service to make a payment. I gave the representative my debit card number. I was informed that it could not be used because it was coming up in their system as a credit card. I told the representative, that my debt card is both a debit, and credit card, she told me they could only accept straight debt cards. Two days later $1519 dollars was charged at Walmarts in Florida. I have never had a problem with this card till I gave the number to them.

My loan has been transferrred 4 times and now I'm with Santander. They have yelled and hung up the phone on me numerous times when I have tried to discuss my payoff and inform them that it is incorrect. I bought a 2005 Chevy Trailblazer back in 2005 (used) and have paid over $30K for it. They are now telling me that I owe over $12K for the vehicle still and will not discuss this with me. I am still paying almost $500/mth for a vehicle that isn't worth anything & I've never been late in all of these 5 years!

I am on the verge of having my car repoed now. I spoke to a manager Jeffery James who said if I paid 400.00 they would modify my loan. I have faxed all requested paper work over 7 times yet some people tell me they have it then I'll get a call stating they do not have it. they told me last night rudely that they don't have to do this for me they are doing me a favor. since they merged with my original loan co. I have had to prove every single payment I have made. the amount they say i owe keeps changing. I was told in March by Mr. James my next payment would be due May 17th these people call me multiple times a day and called my friend who used his credit card to loan me the 400.00 to start the modifiation. I've ased them not to call him yet they continue. Even though I call every day or every other day they continue to call and harrass me and talk down to me. They have me so stessed that at times I feel suicidal. they don't know what they are doing over there. They are causing me so much distress I may lose my job! there is a lot more to tell you I have started keeping notes and all my paperwork and fax confirmations. due to their constant harrassment. Please help me

My car was financed through HSBC. Since it was sold to Santander we have had constant phone calls from them.
I am a legal assistant that does debt collection, so I know the rules of the FDCPA.
I recently sent them a letter asking them to verify the amount they are telling me I owe. They say I owe a specific amount and can't tell me why, but they have continued to call me. These calls were all placed to my cell phone so I can document the violations and have records of their calls.
They told me my payment history was online that I could research the payment history myself that they don't ever do that for anyone. Then she got very upset, when I asked for a supervisor they refused. If they say I owe the money they should tell me what it is for but not one person can tell me. One said late fees, one said the remaining portion of a past due bill, etc. I've heard it all.
They violated the FDCPA by continuing to call my husband at work after they have been told to cease from doing that.
Regardless, I am collecting data and I will file a lawsuit once I get more information.
I would like to be one of the lead plaintiff's as I have and continue to collect proof of the violations.
Right now, I have about 8 violations of the FDCPA in the past 2 weeks and I would like to have 20 or more before I file. However, at the rate they are going that won't take very long!

I paid Santander early February - said payment was cashed BY THEM two weeks later. Since then they have posted late fees each month for a payment I have proven to them by Faxing a copy of both sides of said check, along with a copy of proof sent directly from my bank! To date they claim to have never received any notice or copy. I have proof that this so call unreceived copy has been submitted more than five times. The final payment on a six year loan is next month....they seem to think that by drumming up these extra bogus fees that I will be forced to pay those fees on a check they've long since cashed...but that IS, how they intend on extorting that money from me (i.e., they'll hold the title until I pay it). I have no intention of paying any late fees.

I bought a car thru a dealership in June 2008 and the car was financed with Drive Financial. I made payments on time until June 2009 when finances prevented me from paying on the exact due date. I still made a monthly payments by phone and paid the $10.95 service fee in addition to the $330.00 monthly car payment. I lost my job in December 2009 and filed for State Unemployment. I was approved for State Unemployment and was sent 2 benefits checks, then the State Unemployment suddenly stopped. Not because I was ineligible BUT due to an error entering my wages. The State Unemployment should have entered in my lowest quarter wage as $9,000.00 - instead it was entered as $900.00 I brought this to the State Unemployment Office BEFORE receiving a final decision of eligibility, because I recieved a letter in the mail stating that I did not make enough money in wages or below $1,200 in a quarter. The rep at State Unemployment told me not to pay attention to the letter because its an obvious mistake. I threw the letter away and shortly thereafter, the weekly benefits stopped because State Unemployment decided to 'fix the error' Even though I will still get the same amount of unemployment, which is the maximum amount, I have to wait 13 weeks for the error to be corrected. Meanwhile, Drive Financial is repossing my car because I am NOW behind in payments due to job loss and State Unemployment typing error. Drive Financial DBA Santander has called my Father and Mother In-Law(s) about 6-12 times a day (EVERY DAY) and threatens, harrasses, intimidates, and tells my In-laws my account status and other personal info about ME. I don't live with them, but since they are a reference, Drive Financial DBA Santander continues to call them. They have told this company to stop calling, I have tried to get in contact with this company, but was always told that I need to speak with Loss Mitigation Dept. which is virtually impossible because of the hours and no voice mail system to leave a message. The repo man came today and spoke with my husband, I was not home and neither was the car. I am currently 4 months behind and have asked for a work out 4 months ago, but nobody at Drive Financial DBA Santander has helped out. This company only intimidates, lies, harrasses and laughs at the customers. I am tired of dealing with unrational people.

I was looking at my husbands statement and his payments are $628.24 per month, but his "total amount due" is 3,195.06. I also noticed that for the last year his statements have shown his total amount due every month to be over 3,000.00. But what I don't understand is if you look under "alerts" they state "your account is 44 days delinquent. Well isn't that like a month and a half behind right????That's a lot of bogus fees and charges i think. So basically what in reading on his statements is that, he purchased the vehicle for $23,900 and has made exactly 31 payments and his new balance is 20,930.93. Wow, so 31 payments @ $628.24= 19,475.44 is what he has already pain and still owes $20,930.93

Trying to sell this car that had a payoff amount of $11,300 4 weeks ago. Santander now says the payoff is over $19,000. Through my own research it appears that they are using the "Rule of 78" as the accounting practice which is not what I signed up for originally. This fight is taking multiple hours per day and I'm getting no where. I think the Attorney General of California would love to get his hands on this one. How many of the $1billion worth of loans Santander acquired from HSBC are in the State of California? These people are screwing the consumer and the original bank, HSBC can now wash their hands of it - although the CLevels at both will be dealing with me directly now. Who wants their email addresses? We have been with Three companys since 2006, Santander has been the one that has caused us the most problems but there latest game was the broke into are garage and took the keys out of our pickup and told me to surrender the car and they would give me back the pickup keys. I have proof of this. I have all the names and numbers. i told them the only way they would get that car back now was to take me to court or send out the cops. So far i have seen nothing of them, but i'm sure i will. So i really need to be a part of this law suit. They have the keys to my home, and other places. I don't feel safe anymore knowing that some wack job has the keys to everything i own. My kids are scared to stay at home what good does it do to lock your doors when they have a key, I really need some help!

I used to have a loan through Sovereign Bank, which was bought out by Santander. Ever since then, my late fees have accrued to over $800 !!! My 2003 Jeep Liberty is only worth $5000 and my loan is now up to $7, 000 because of all of the fees. I have tried working with Sovereign after Santander, and Santander, and they have been rude and more than unhelpful. I moved from Delaware to Arizona summer of 2009, and it took me 2 mos to get them to release papers for be to verify to Department of Motor Vehicle that I do in fact have permission from Sovereign/Santander to register my vehicle in my own name! I am so lucky that I didn't get pulled over by the police. I have tried numerous times to work with them and even find out if there has to be a ceiling on the fees as they will be close to $1, 000 soon. I don't know what else to do~! I have been in contract with drive financial since 02/2007. I have the original contract and have repeatedly asked why my down payment was applied to my finance charges. I have been told everything from the salesperson(from the dealership) has the payment until today (03/18/2010)that they have the payment. I went over the contract terms and we seem to have two different contracts. I didn't sign for the amount that Santander is claiming. In addition, the accounting on account has been miscalculated many times I have requested an accurate accounting, but I receive no response. I have been called and harrassed for late payments on holidays and 6am to 10 pm. This is obviously illegal.

Towards the end of 2009 I fell behind two car payments. When I received my Income Taxes I called to make a payment. When I spoke with the Santander Representative I told them that I wanted to make two sepererate payments. One to cover the two payments I was behind and one to cover the late fees. I was told that one mass payment would cover both. When I received my bill for March there my payment was less then normal and I still had late fees. When I called to ask about this I was told that the small amount I paid for the late fees in Jan went towards the principle of my loan and not towards my late fees. This is actually the second time that they had done this to me.

In June 2009, I tried to contact Santander about my car note and get a deferment to do car repairs. I was basically told that I could not get a deferment because I was not behind on payments. I was then told that according to their system, I didn't have a payment due (other than 50 cents), and that my next payment would be due in a month of the normal amount. I verified this information, and proceeded with my car repairs. 5 months later, I start getting calls that I am a payment behind. I tell them what occurred earlier in the year, and asked again for a deferment. I was told they could not give me a deferment. Since then, they have been calling me up to 8 times a day, every day! I continue to make my normal payments, plus $30 so that the late fees to do not pile up, as I continue to try to get the issue worked out. I have sent letters which were ignored. Representatives are rude and refuse to talk to me about anything other than immediate payment over the phone of one payment plus fees. In reviewing my account, it seems that my payments are not being properly applied to principle...even noted one month when only $107 of my $567 payment was applied to principle, when the months before and after $300+ was applied to principle. I notice that the principle payment keeps going up and down, as Santander takes more interest on some months than others. I've also done the math on what they say I owe, and how long I should have left to pay, and I can easily see them trying to get an extra $2000 lump sum out of me at the end of the note. I feel these folks have killed my chances of refinancing, and I'm stuck with them for another 3 1/2 years. I need help! I lose sleep at night wondering if they are going to repossess my car over 1 payment and fees, and have ended up in numerous arguments with them over the phone. These people are crooks!

My acount is a half a paymet late. I had called them and was surpose to be making arraigment for the week I get my unemployment check.
They starts calling at 6:00 a.m.-11:00pm. All during that time it's an 30 minute interven then the calls starts again.
At one time it had gotten so bad, that one caller will be on the phone with me and the other would be on the phone with my cosigner..
No matter what you explains to them, they get so rude and will tell you what you need to do. I only get $174.00 a week from umimployment. I have to explain every 30 minutes when they calls. When the next calls 30 minutes later, they will get rude and say that you never called and talked to anyone..
Since they have started all this calling, my doctor has put me on depression meds and ambians meds. To calm me down and help me sleep.
My mom has even been getting the treating calls from Drive looking for me. She is bed ridding sick. They have even talked so ugly to her as well. She tries to explain that she is sick. They told her that;s not there problem, she just need to get the message passed.

The per diem and high interest has over inflated the car pmt so bad that I am blown away. I wouldn't have known a per diem was invovled if i didn't engage in web chat with a rep and asked straight questions about how my payment history and interest has my payoff so out there that they don't match at credit bureau, statement, or their website.
When loan started in 2007, paid fine until had child early by emergency basis and became unemployed. The car was repossessed and i was able to recover the vehicle and hasn't missed a payment since. Now that Santander has taken over, the constant calls and no disclosure about fees or per diem and information not in line at all at any 2 sources at the same time.

In early 2008, I was out looking for a vehicle. I stopped by Bill White's Hyundai of Russellville, AR. We (my fiance and I) test drove a couple cars and then they brought us a brand new 2007 Sonata that they needed to get rid of. We test drove the Sonata overnight, and really liked it. We went to the dealership the next day and told them we wanted the car. With a sale price of $19, 000. We had no credit and no co-signer, so the dealership decided to pull a couple strings to get a deal worked out for us. We were told that if we would make a $2, 000 downpayment, and accept high payments (625/mo) for the first year making every payment on time, we would definitely be able to refinance and be looking at payments around 325/mo. This deal was also to include sale tax being paid. After a couple hours we signed for the car, and drove home. That next week, I went to get tags on the car the the revenue office. Everything was going fine, til the lady behind the desk put our shiney new plate on the counter and said very delicately "That'll be 2200 bucks" I just stood there and looked at her knowing she was joking. turns out, they didn't pay the sales tax, also turns out that part of the contract was removed prior to us returning to finalize the deal after the test drive. After driving for 30 days without tags, and not having the money to pay to get them, as we were paying $625 for the car, it found a nice resting place in my front yard. Months went by and we made every payment on time, while saving for tags. 10 months into the payments and about $6, 250 plus the $2, 000 down I contacted Drive to ask about refinancing. They very generously disclosed this little factoid..."WE DON'T REFINANCE"..I asked to talk to a supervisor, which probably really meant I was bounced to the next cubical. Everyone I talked to told me the same thing. I was really pissed at this point. After paying 625/mo for 10 months with the promise from the dealer of being able to refinance we still didn't even have tags and the car had only 3, 000 miles on it with one oil change. I went up to the dealer to yell at someone, to my surprise however, I learned that the whole team that was there when I purchased my car had been fired because of the way they were conducting business. The new supervisor was very friendly and tried to do everything she could to get me financed by another company. However, even with building our credit scores from 0's to 700+ we couldn't be refinanced because the original loan (625/mo for 60/mo) came to almost 40, 000 which was twice the value of the car. I also found out that they got us approved by saying that we were married. I immediately stopped making the payments and received harassing calls from Drive Financial on a daily basis. Everytime it would be a different person and by this point I was tired of talking serious to these people (and explaining the above story EVERYTIME, with each person saying "um okay sir, I'll make a note of that on your account") and took on the "sarcastic asshole" persona. The last lady didn't like this and said "Sir, if you don't make your payment's we will come and take your car." I said "F*ck it, the car is yours just come and get the piece of sh*t" she replies with "sir the car isn't ours, the collateral is"...I finished with "The car is the collateral you stupid B*tch! and hung up. A year later, I walked outside one morning and the car was just gone. No one knocked on the door to ask for keys, no phone calls, no letters to this day. All I know is the dealership where we purchased the car is now closed down. Waiting to get a letter saying they're dragging us to court.

Financed my car for 10,000 three years ago and the balance is still 7,000. Had to deal with the same issues the whole time I've had the car. Today was the last one. I was put on a deferment and was supposed to start regular payments in January. I have talked to them once a week to let them know where I am with getting the money. Now today, they claim I owe double my regular payment for December as well as January and February. I JUST spoke with a rep last week and that was NOT the case. This is not the first time this has happened. They also claim I've only made 2 payments in the past year. BULLCRAP! I have not only used my bank account, but western union and money gram to meet their needs. They call EVERYONE in my family and people that I worked with 8 years ago who I don't even talk to anymore telling them my financial situation. They tell them how far behind I am and how much I owe. This is immoral! They call my house 40 times a day and my mother just said today that some lady called there being extremely hateful with her telling her she needed to give them my location. I JUST TALKED TO THEM LAST WEEK!!!!! The entire city knows my financial status now and I am devastated! I don't want everyone that I ever worked with or knew knowing I'm a day late on my payment. And it doesn't matter if you make arrangements, they still call a million times. I am a single mother with three children who doesn't get child support and I do good to make the regular payment, and they keep adding past due amounts on there that weren't on the previous statement or that they didn't mention before. This is ridiculous and I am now stuck in a horrible situation...either let them repossess the car because I owe double what it is worth, not to mention the car is a complete LEMON and doesn't run half the time or keep paying for it and letting them add a payment here and there until I end up paying 30,000 for this stinking car! They are very rude and hang up on me, then tell me they can't help what the last person told me last week, this is what it is today...BULLCRAP!

fiancial industries should be more closely regulated on all levels . not just housing. Long story short ..if you get a car that sells for 11000 used and end up with a loan through this company that ends up to be 30000 the interest being collected is predatory and should be illegal. refinancing? not an option for most conventional upside down loans besides they charge to buy out the loan. Overpaying is prevelant in subprime or areas of disparity by companies like this that are allowed to operate. Understood that most companies are in business to make a profit but almost triple what the value of the car is being sold at the dealers is just not considered good business practice.

I contacted them in June 09 due to knowing I would be out of work for a while due to having back surgery. I was told to have a due date change and if I still was out of work in July to call back & they would do another one. I was then told that if I made a $210.00 payment by 8/15 they would do it. I borrowed the money to do this since I was still out of work. Then I find out from Russ a manager that only 1 due date can be done during the term of the loan and that deferment was not for me. I spoke with Bruce a supervisor on 2/10/10 who put in a two month deferment request which was denied less than 24 hours later. When questioned as to why the deferment was denied I was told because my account was in good standing with them and that I always seem to make my payments even though they say I am behind 25 days and receive 20 to 30 calls a day. I also almost lost my job because of them calling and requesting my husband too many times. My husband and I are struggling because we are behind in all our bills due to my surgery that was a have to have. They do not care about their customers at all and are predatory of people who have less than perfect credit! Something must be done.

I purchased a car and the dealership set up my loan thru drive/santander, the dealership closed and did not pay bank that owened the car for the car and Santander could not get the title for the vehicals so we could not get tags/ registration for vehical so we took car back to them and they are still trying to hold us accountable for the loan even though they shut our accounts down for 2months and would not accept any paments. Then the ay after I rurned the car to the they reactivated my account and post me as 60 days late and put a voluntary repo on my credit.

We have nothing but trouble with this company. Unlawful repo after the payment we promised them was paid and then was basically told owell, calls to familiy members that they DO NOT have permission to speak to, constint FDCPA violations, calling us 5+ times a day even if we made a payment te day before and have told them that no payment can be made for a couple more weeks, unbeleivable fees that that will not explain to us what they are for. Very rude CSR, A manager NEVR seems to be around or they say they do not have the option to transfer a call. Calling my familiy members that are NOT on my loan and offering them money to locate us or make a payment even though they spoke to us 10x in the past week. I could go on and on. I do not understand how a company like this is not out of business. My husband and I would be aboard with any and all that would want to sue this company. Every single thing they do there is illegal and violates alot of laws.

I signed paperwork that I had an interest rate of 13% but when I received the paperwork my interest rate stated 15.03%. I have late fees being charged when they shouldn't be. I have proved that I shouldn't have them but they continue to apply them. Rude customer service reps & management. Harrassing phone calls for no reason.

I wanted to pay my loan off early, but they told me I couldn't. I would still be charge the full interest rate. My car payment is due on the 8th. I paid it on the first and then I recieved another statement saying it is due on the 8th, but I already paid it!! I have a copy of the check, but they told me they need to get it by the 8th or the car would be repo. It is crazy because my payment shows up on my account. Oh and they won't let me access my online account anymore!

I too have been harassed and feel like I'm gonna be paying for a car that's worth 3000.00 for 10 yrs. They called my cousin and gave her a complete run down of my account history, and told her that I need to call them to avoid my car being repossessed. (I was 1 month behind) This is the worst mistake I have ever made. (getting a loan from them). It stresses me out, day in day out, my phone rings...NON STOP. I receive at least 8 calls per day. I just googled their name, and I'm so happy to know I'm not the only person going through this with this company. They should be shut down!

They also charge me fees and penalties each month that are approximately 360 per month...my payment is only 468...how in the world am I supposed to catch up when I am virtually making two payments each month??? These people are sick, heartless bastards and they need to pay

I originally purchased a car in 2/2000 that was financed by Triad. Also in 2000 I was in a horrific car accident where the vehicle was totaled with 2 major and 1 minor injuries which I was included an injured party. I was also pregnant at the time of the accident and could no longer work. I was unable to continue to pay for the totaled vehicle. Triad then charged off the purchase and placed a negative mark and charge off on my credit report. The negative entry fell off my credit report in 2007. Santander Consumer USA purchased Triad in Novermber 2009 and then placed a collection on my credit report with a new close date of November 2009. This new item's date of deletion is now 2016.

Before our payment was due both of our phones were ringing off the hook at the same time. Our payment was due on the fourth of the month and these phone calls started at the end of the previous month.
I called to make a payment and asked what the full balance was, they told me we only owed the payment. I paid this payment, yet when the bill came for the next month a late fee of $55.16 appeared even though the customer service representative didn't tell me of this fee when I called to pay the bill. We now have a charge of $55.16 on our bill as a late fee. We were told that it was a late for Aug, Sep and Nov for $13 a month. You do the math (13 x 3 = not 55.16)
Lastly, I wanted to say that we purchased our vehical at Carmax. Carmax pretty much apologized to us because they know how many problems people have with Drive Financial now know as Santander Consumer USA.
This company should be made to close.

Santander repossess our car claiming a payment had not been received in 7 months. Santander had taken over Sovereign Bank and we continued to send payments to Sovereign but the payments were being placed into a "lock box" & not being forwarded to Santander. Additionally, Santander had received a double payment & upon filing a complaint with the PA Banking Department was forced to return it which they still claim caused our account to be past due even though we never missed a payment. Short into long, they repossessed the car. We have bank statements proving we never missed a payment but they still claim we did. We were forced to make a payment 5 times more than we owed and the very next day after receiving the payment they placed the car up for auction. Through the PA Banking Department, we were able to bring enough attention to the case to force Santander to release the car but it had been detailed and set for sale after we had made the payment. We were forced to pay several hundred more dollars to get the car out of storage. We are now being assessed hundreds of dollars in "fees" which they refuse to break down. They have lied, stole our vehicle and even damaged the ignition because they replaced it with a cheaper one when it was detailed.
We need help. We are out of a couple thousand dollars now and it keeps going up.

They have harrassed me on my job, and all my references i used on my apllication. I was late in sending a payment I sent them a payment and they picked up the car later that night. When they did pick up my car they took it to a whole different place. I had to fin*d someone to take me to go and get my car after I came up with over 2100.00 for them to give it back not including what the compnay charged me to give it back. The company they used had two employess that havd conviction records. I kept telling them that I made the payment and they said they could care less and they had there's and to deal with them. after all of that transaction. I told them I saw them some where before and they became quiet and would not say anything but I kept on insisting that I did so later on the morning when business started opening it came to me where and they had been convicted of theft before, so you figure. Since they had once taken my car i owe them out the butt for late charges after charges but remember i just gave them over 2100.00 earlier to get my car back. It seems by blance is not reducing at all. They contiuelly call my employment I have told them not to call me there and they continue and then get rude on the phone because they know I cant say anything out loud so oneday I lost with them in my office and everybody now know my personal business and which they should'nt. My mom in on on assistance and they have threatened her and that is where I draw the line because she cant take care of my debt. Nobobdy will refinece you on a car that is worth so little but yet you have a large balance. They kind laugh at you and ask wahat you were thinking but we all know we need some kind of transportation so we settle for those who call themselves helphing you get back on track. How many of us know now it is not getting back on track nor is it helphing our credit either. Something really needs to be done about them because they are a riffoff. I am to the point in letting the car go back because I the payments themselves are hurting me and they are 610.95 and that is not including all the fees they keep putting on my account every month so I will never see the end of the road with them.

I am also a victim of Drive Financial now Santander Consumer USa My husband and I paid over 18,000 to this company for a 2005 truck and was stil told we owed over 22,000 more dollars for the vehicle. We were paying 652 month and got behind and one night a repo man showed up at our door. When I called the company back they said that we could have it back if they did a remodification on our loan which would decrease the payments but added 14 more months on to the loan. I told them that you are already saying we over over 22,000 for an almost 5 year old car in which we have already paid 18,000 into no way am I going to pay this plus more interest. This company is on ripoffreport.com and is a major rip off.

Account with Drive in August 2004. Making scheduled payments for several months to find out by Drive that the payments we were making were not payments for our monthly note...something about not enough for the down payment??? We have had harrassing phone calls to us our family and friends that we did not list on lthe application for the car...they even tried sneaky tactics as they would speak to my daughter to make her beleive that they were a friend of mine. We would make a payment and then the next day call to demand payment for the next month when it was not due. They would call my husband and tell him that we were two, three months past due, or they never got payments....my credit has been destroyed by them. 11/2009 I find out that they charged off my truck and I had no idea. The repo man came and got it but was rude as if we had something that belonged to him. They lie, take your money, harass, no customer service, they make arrangements with you for you to find out that it's been noted that the arrangement was defaulted and now you end up behind and can't understand what happend... WE NEED HELP AGAINST THIS ... ALL CUSTOMERS OF DRIVE/SANTANDER NEED SOME HELP
